These Terms apply to all visitors to Casa Creativa, whether pre-registered or registering on-site. 1. Acceptance of Terms By registering as a visitor, either through our website, NexIO or, on-site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you should not visit Casa Creativa. 2. Visitor Registration and Check-In - 2.1 Pre-Registration: Visitors who are pre-registered will receive a copy of these Terms via email along with a link to agree to them before their arrival. Pre-registration ensures a quicker check-in process. - 2.2 On-Site Registration: Visitors who have not pre-registered must complete the registration process at the reception upon arrival. All visitors must present a valid ID and agree to these Terms during the check-in process. - 2.3 Visitor Badge: Upon check-in, visitors will be issued a visitor badge, which must be worn at all times while on the premises. The badge must be returned to reception upon departure. 3. Conduct and Use of Premises - 3.1 Purpose of Visit: Visitors are permitted on the premises for business purposes, meetings, or events as arranged by their host. Visitors are not permitted to use workspaces or facilities unless explicitly authorized. - 3.2 Respectful Behavior: Visitors are expected to conduct themselves professionally and respectfully at all times. Disruptive behavior, harassment, or discrimination of any kind will not be tolerated. - 3.3 Restricted Areas: Visitors must remain in designated areas as directed by Casa Creativa staff or their host. Access to certain areas may be restricted, and visitors must not attempt to enter these areas without permission. 4. Health, Safety, and Security - 4.1 Health and Safety Protocols: Visitors must adhere to all health and safety protocols as communicated by Casa Creativa, including emergency procedures, fire safety guidelines, and any COVID-19 or other public health measures in effect. - 4.2 Security: Visitors must not leave personal belongings unattended. Casa Creativa is not responsible for any lost, stolen, or damaged property. - 4.3 Incident Reporting: Any accidents, injuries, or suspicious activities must be reported to Casa Creativa staff immediately. 5. Data Protection and Privacy - 5.1 Personal Data: Casa Creativa will collect and process personal data as necessary for visitor registration, security, and safety purposes. This may include your name, contact information, and visit details. - 5.2 Use of Data: Your personal data will be used in accordance with Casa Creativa’s Privacy Policy, which is available on our website. By agreeing to these Terms, you consent to the processing of your data as described. - 5.3 CCTV Monitoring: Casa Creativa premises are monitored by CCTV for security purposes. By visiting our space, you consent to being recorded. 6. Liability and Indemnity - 6.1 Assumption of Risk: Visitors enter the premises at their own risk. Casa Creativa is not liable for any personal injury, property damage, or loss incurred during the visit, except in cases of gross negligence or willful misconduct by Casa Creativa. - 6.2 Indemnification: Visitors agree to indemnify and hold harmless Casa Creativa, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorney's fees and costs, arising out of or in any way connected with their visit. 7. Governing Law and Jurisdiction These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or in connection with these Terms shall be resolved in accordance with the Arbitration Act of Kenya. 8. Modifications to the Terms Casa Creativa reserves the right to modify these Terms at any time, with or without notice. The latest version of the Terms will be available on our website, and your continued access to the premises following any such modifications constitutes your acceptance of the new Terms. 9. Miscellaneous - 9.1 Entire Agreement: These Terms constitute the entire agreement between you and Casa Creativa regarding your visit and supersede any prior agreements relating to such visits. - 9.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. - 9.3 No Waiver: Casa Creativa’s failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
